1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you and Vizulation Games ("we," "us," or "our"). By accessing or using our mobile applications (the "Services"), you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the Services.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content") and the trademarks and logos contained therein (the "Marks") are owned or controlled by Vizulation Games and are protected by copyright and trademark laws.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

• (1) you have the legal capacity to comply with these Terms;
• (2) you are not a minor in the jurisdiction in which you reside;
• (3) you will not access the Services through automated or non-human means;
• (4) your use of the Services will not violate any applicable law or regulation.

4. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activity includes:

• Circumventing, disabling, or interfering with security-related features.
• Engaging in unauthorized framing of or linking to the Services.
• Interfering with, disrupting, or creating an undue burden on the Services or the networks connected to the Services.
• Deciphering, decompiling, disassembling, or reverse engineering any of the software comprising the Services.

5. SUPPLEMENTAL TERMS FOR ARCADE SERVICES

A. Third-Party Services & SDKs

The Services incorporate third-party SDKs, including but not limited to Unity LevelPlay and Google AdMob. You acknowledge that Vizulation Games does not control these third-party services and is not liable for any technical failures, data breaches, or content/advertisements served by these external providers.

B. AI and Data Scraping Prohibition

Users are strictly prohibited from using any automated systems, AI-crawlers, or data-scraping tools to extract game assets, source code, or metadata from the Services for any purpose, including the training of machine learning models or the creation of derivative works.

C. Leaderboard and Username Conduct

Vizulation Games reserves the right, at its sole discretion and without prior notice, to remove, edit, or ban any username or high-score entry that is deemed offensive, fraudulent, or achieved through the use of cheats, hacks, or exploits.

6. DISPUTE RESOLUTION

A. Informal Negotiations: To expedite resolution, the parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.

B. Binding Arbitration: Any dispute arising out of this agreement shall be determined by binding arbitration in United States, New Jersey. The arbitration shall be conducted on an individual basis; class arbitrations and class actions are not permitted.

C. Limitation on Time to File: Any claim must be commenced within one (1) year after the cause of action accrues.

7. LIMITATION OF LIABILITY

In no event will Vizulation Games be liable to you or any third party for any direct, indirect, or consequential damages. Notwithstanding anything to the contrary, our liability to you for any cause whatsoever will at all times be limited to the lesser of the amount paid, if any, by you to us or $50.00 USD.
